Ask Joe: Can I get my money back from home warranty scam?

From the Ask Joe file, News 4 is following up on the growing number of complaints against a home warranty company.

Seven viewers have written in, including Sherly Mathew, who said she saw our story on Sensible Home Warranty and she is also a victim. She paid $1,270 in advance, and then found out the company has shut down.

She wants to know if there is anything she can do to get her money back?


This is a story News 4 first reported on earlier this year. There have been hundreds of complaints filed against Sensible Home Warranty with the Better Business Bureau in northern Nevada. The company took payments from people, and then in many cases, did not deliver when it was time for service.

Joe checked with the Nevada Division of Insurance this week. They regulate home warranty companies, there is good news if you were a victim. First, the agency pulled Sensible Home Warranty's certificate of authority, meaning the company is no longer allowed to do business in Nevada.

More important, they have filed a $25,000 security bond with the state, and the Division of Insurance is in charge of doling out that bond money to customers who were ripped off. So, what you need to do is contact the Nevada Division of Insurance in Carson City at 687-0700. Tell them you are a customer of Sensible Home Warranty, and that you want to file a claim to get your money back.

It is a complicated process, but that is what those security bonds are for. They are required, so that customers can their money back if a company does not operate in good faith.
