LAS VEGAS (CLARK COUNTY DISRTICT ATTORNEY NEWS RELEASE) - Clark County District Attorney Steve Wolfson announced today that Assemblyman Steven Brooks was charged with various criminal offenses stemming from an alleged domestic dispute with his estranged wife which occurred on February 10, 2013.
Brooks is charged by way of Criminal Complaint with one felony count of Resisting a Public Officer With Use of a Firearm, one gross misdemeanor count of Assault on an Officer, and two misdemeanors, including Battery Constituting Domestic Violence and Obstructing A Police Officer.
If convicted, the felony charge carries a maximum sentence of five years and $10,000 fine.
A summons will be issued for Brooks to appear in Las Vegas Justice Court.
CRIMINAL COMPLAINT:
The Defendant above named having committed the crimes of RESISTING PUBLIC OFFICER WITH USE OF A FIREARM (Category C Felony - NRS 199.280); ASSAULT ON AN OFFICER (Gross Misdemeanor - NRS 200.471 (2) (c)); BATTERY CONSTITUTING DOMESTIC VIOLENCE (Misdemeanor - NRS 200.481; 200.485; 33.018) and OBSTRUCTING A PUBLIC OFFICER (Misdemeanor - NRS 197.190), in the manner following, to-wit: That the said Defendant, on or about the 10th day of February, 2013, at and within the County of Clark, State of Nevada,
COUNT 1 - RESISTING PUBLIC OFFICER WITH USE OF A FIREARM did wilfully, unlawfully, and feloniously resist, delay, or obstruct Officers T. PERALTA and/or C. NELSON, Las Vegas Metropolitan Police Department, public officers in discharging or attempting to discharge any legal duty, to-wit: by struggling with said Officers, putting his hand on Officer T. PERALTA'S duty belt, reaching for the firearm on the belt saying "I've got your gun," Defendant removing, taking, or attempting to take or remove a firearm from the person of, or the immediate presence of, the public officer in the course of such resistance, obstruction or delay.
COUNT 2 - ASSAULT ON AN OFFICER did wilfully, unlawfully and intentionally place another person in reasonable apprehension of immediate bodily harm and/or did unlawfully attempt to use physical force against another person, to-wit: C. NELSON, a Police Officer with the Las Vegas Metropolitan Police Department, while the said C. NELSON was performing his duties as a Police Officer, and said Defendant knowing, or should have known, that the said C. NELSON was a Police Officer, by attempting to punch the said C. NELSON.
COUNT 3 - BATTERY CONSTITUTING DOMESTIC VIOLENCE did then and there wilfully and unlawfully use force or violence against or upon the person of his spouse, former spouse, any other person to whom he is related by blood or marriage, a person with whom he is or was actually residing, a person with whom he has had or is having a dating relationship, a person with whom he has a child in common, the minor child of any of those persons or his minor child, to-wit: ADA BROOKS, by grabbing the said ADA BROOKS by the hair.
COUNT 4 - OBSTRUCTING A PUBLIC OFFICER did then and there wilfully and unlawfully hinder, delay and obstruct Officer C. NELSON, Las Vegas Metropolitan Police Department, in the discharge of his official powers or duties, by refusing instructions of Officer C. NELSON to stop putting his hands in his pockets and pulling away from him. All of which is contrary to the form, force and effect of Statutes in such cases made and provided and against the peace and dignity of the State of Nevada. Said Complainant makes this declaration subject to the penalty of perjury.
