Man arrested for alleged sexual assault released from jail

MINDEN, Nev. (MyNews4.com & KRNV) -- According to Undersheriff Paul Howell with the Douglas County Sheriff’s Office, Derek Paul Kalaman -- who was arrested last week for allegedly sexually assaulting a 5-year-old -- has been released from jail.

Howell tells News 4 charges are not being pressed against Kalaman at this time due to lack of sufficient means to keep him in custody.

According to court precedent, a suspect's confession or admission of a crime is not in itself adequate evidence upon which to file criminal charges, and -- although Kalaman confessed to molesting the victim at least three times over the course of one year -- court precedent overrides it.

Howell states there have been unique challenges in the process of interviewing the child victim, but preliminary investigation suggests the victim’s mother and Kalaman were in a relationship of sorts.

Howell says the investigation is ongoing to develop other evidence in addition to the Kalaman's confession.

That's BS they should send he's a** to the penitentiary! bet u anything he would have a lots of convicts waiting to be he's new best friend (there b****) I'm sure they wouldn't mind playing with him. He used to work at the same place I did I WISH I WOULD OF KNOW THEN.

Unfortunately, the law is the law whether we agree or not. However, I think most of us can agree that nobody wants to see this guy walking the streets. The really scary part in all of this, is that pedophiles who receive jail time and counseling are often times repeat offenders upon their release back in to society. I believe it is nearly impossible to rehabilitate someone who is mentally unstable enough to harm a child in any way. Tax payers spend billions keeping these criminals locked up, where they often receive counseling services. This guy, who has faced no repercussions for his actions WILL most certainly attack again. These types of people are innately mentally sick people. As a community, all we can do in this situation is take extra precautions to ensure the safety of our children. I have to imagine the mother of this child, who presumably unintentionally put her child at risk in the first place, is probably feeling pretty terrible at this point. However, safety starts at home. Such a disturbing case all around.

Court precedent? NO, that is the LAW. There has to be independent evidence that a crime was committed otherwise the prisons would be full of lunatics who confessed things that they never did.

This is an outrage that the sheriff's office has released this monster back into our society where there are a lot of 5 year olds to rape. I want to go picket the Gardnerville police station for doing this!! He admitted he did it, so they release him? What? I'm so angry right now. Do we have a bunch of perverts working for the Gardnerville cops or what? Why did they let this man go so he can rape that child again??? He admitted it!!!
