YERINGTON, Nev. (MyNews4.com & KRNV) -- There is more controversy on Tuesday over that fence in Fernley that has prompted the Lyon County School District to file a lawsuit because of access issues.
A trial has been set for the lawsuit the Lyon County School District filed against Kevin Evanoff. The lawsuit was filed after Evanoff built a makeshift fence on his side of a private road to keep parents of students at East Valley Elementary School from parking there.
The district is suing for $10,000 in damages and attorney's fees from Evanoff. But school district attorney Don Lattin said they want to settle out of court before the trial in August. "We can provide him some measure of comfort with the liability issue, and put a fence up so no one can throw things across or park there. We can have the property to maintain it, and so we can have access to our school."
But Evanoff said he wants a jury of his peers to decide who is right. "I know I can have a fair trial and I can beat the school. Because all the school is, is a bunch of big bullies."
Evanoff requested a delay to find an attorney. The Judge set a trial date for August 14, and the temporary restraining order will be extended until then.
Evanoff still has to file an answer to the lawsuit by the deadline in the document.
