Pedro Martinez not given notice of paid leave

RENO, Nev. ( & KRNV) -- New information regarding the dismissal of Superintendent Pedro Martinez shows the Washoe County School District did not give Martinez verbal or written notice of his paid leave.

News 4 requested a copy of the alleged memo given to Martinez, and the School District responded saying "There is no such memo."

Martinez said he was not given verbal or written notice indicating he is on paid leave -- the only time he has heard of this status has been through the media. According to Martinez, Board of Trustees President Barbara Clark said the board was done with him, and his contract has come to an end.

Last Friday, Clark released a memo stating Martinez was on administrative leave with pay, and that this has been his status since Tuesday, July 22nd. This memo came three days after Clark said Martinez was relieved of his duties.

jwreno writes: "Look specifically at NRS 391.305". This provision deals with a requirement to maintain a license if it required as a condition of employment. Essentially, a teacher's license for instruction. That doesn't really apply to the Superintendent. Even more important, a CPA license isn't required as a condition of employment for the Superintendent position anyway. Probably best not to cherry-pick NRS without understanding to whom it applies.

Unfortunately, NRS 391 is total toilet paper to school districts like WCSD. Administrative law is a complete joke, as I know only too well. They do whatever the hell they want to teachers and ruin them by faking charges. The "unions" in Nevada are useless and often in bed with the school districts. The ONLY reason you are hearing about the sleaze that is WCSD is Martinez has the profile and the financial wherewithal to fight back.

Why should Martinez "shut up"? If and when he settles, he will be forced to sign a "gag order," and then the public will NEVER know anything. Then the district is free to go around and target the next victim. He's doing the public a huge favor by speaking out because by speaking out he is telling the truth about your utterly lawless, utterly corrupt, school district.

I see and read assumptions and arguments from some people thinking that he is an At-will employee, or even stipulations due to his contract. Nevada LAW supersedes all contracts or employment in regards to ALL Nevada's educational personnel. From interview to termination or retirement; everything is governed under NRS 391. Look specifically at NRS 391.305.

Once a lawsuit is filed, all parties involved should just shut the hell up! Quit trying your case in the media and save it for the court. Now I hope the court tosses his case for blabbing too much and WCSD really fires his ass for the same reason.

LASD - go ahead and read it. Pay attention to section 14. Since there are terms in place for termination, "at-will" doesn't apply. I guess in your terms, the Board should have had the "smarts" to read the contract a little closer.

Better read his contract and the agreement he agreed to at time of hire, he was an "At Will" employee, nothing in it he didnt agree to so that is his problem. Anyone with his "smarts" would have read the contract a little closer.

or just typical, old-style Washoe County indifferent bureaucracy. I'm like, the Health District (oh sorry, District Hlth. Dept.), the Air Quality Management District, most of both Big Cities, and so on... Parr 4 the curse

Things aren't looking too promising for the WCSD Gang of Six. Everything they come up with just uncovers more lies, deception and misdirection. A tremendous failure in character and integrity.
