Second lawsuit filed over cash seizures

WINNEMUCCA, Nev. ( & KRNV) -- A second lawsuit has been filed against a member of the Humboldt County Sheriff's Office over accusations of illegal cash seizures. One man has already sued, claiming Sergeant Lee Dove took $50,000 from him during a traffic stop, even though he was not cited for anything.

A new case was filed this week by a Colorado man named Ken Smith. Smith says Sergeant Dove took more than $13,000 and a gun from him during a traffic stop in Winnemucca. Smith was arrested on a warrant, but the suit claims he was un-arrested, after it turns out the warrant was for someone else.

Both cases have been filed in federal court.

I wonder what those fellows and their friends/families think about the war on (some) drugs now.... asset forfeiture without due process is more common than most people realize.

I for one hope the suits are successful. This type of behavior cannot be allowed. The law seems to be lacking in Humboldt.
