OAKLAND, Calif. (AP) — A woman who claimed she was sexually assaulted by a nurse while unconscious at a Fremont hospital has filed a federal lawsuit.

The Oakland Tribune reported the suit was filed Wednesday against 31-year-old nurse Jon Quianzon and Washington Hospital.

Quianzon was charged with five felonies in connection with sexual assaults on two different women, one in June 2010 and another in October 2009. He is free on $135,000 bail.

The plaintiff argues the hospital was responsible for the 2010 assault because it failed to alert police after the earlier assault. The suit also alleges the hospital did not conduct a proper background check before hiring Quianzon.

In a statement, the hospital said it took immediate action after learning of the alleged assaults in June 2012.

Quianzon's attorney declined comment.
