$2M bail for accused killer of Nevada trespasser

RENO, Nev. (AP) — Bail has been set at $2 million for a 73-year-old former school teacher accused of murder in the shooting of two unarmed trespassers that is bringing attention to Nevada's "stand your ground" law.

Wayne Burgarello says he was acting in self-defense in February when he killed a man and seriously wounded a woman he found in a vacant house he owns in Sparks just east of Reno.

His public defender, Justin Champagne, wanted bail set at $20,000. He insisted the elderly man is not a flight risk and said it will be impossible to post such excessive bail.

Sparks Justice of the Peace Chris Wilson said the seriousness of the charges and the safety of the community outweighed any presumption of innocence at Thursday's bail hearing.

You can't judge him on the actions he took. You cannot stand there and tell me if someone was in one of your houses and you walked in you would have grabbed a seat next to them shared some meth and called it a day. What happened could have been 100% prevented if they would have been law abiding citizens and not tresspassers. He got the ultimate punishment for a risky decision. We are allowing stupidity to be a normality. We can either call them trespassers and say it was Wayne's right to shoot them on his property. Or we could set the standard of allowing homeless to enter and will and punish anyone that protects there assets. Which one sounds idiotic to you? You got it the action our beloved government took. We protect illegals and criminals here! Quit allowing stupidity to be a normality by protecting ignorance!

the bail seems excessive to me, but this guy was also excessive in his use of a firearm. I'm a vet and a gun owner so don't go there.

Couldn't have called the police, just shoot the poor people, probably homeless and just a place to stay, people are always to quick to just pull the trigger, sickening. And I am a gun owner.

jimbobo or what ever you call yourself. Obviously you have never been trained in the Military or L/E. Those of us who carry open or concealed are not a threat to any law abiding citizen...........only criminals. How about the brave 32 year old with a CCW in Las Vegas who saved countless people in Walmart last week? Could have been you in the back of the store. To all cry baby liberals who hate us that support the Second Amendment and what it stands for I offer you this: Post a sign on your front lawn that reads " NO FIREARMS IN THIS RESIDENCE".........wait and see what happens.

The pos trespasser (male) is dead, the female hd injuries but lived and the female told authorities that they had been doing meth through the evening. This man should not a 2 million bail, he is not going anywhere, if he was planning that he would have been gone while he was out during the investigation.

@jimroby0---You must be terrified walking thru the parking lot on your way into and out of those establishments...after all the only thing between you and death is the desire of that Prius driving whack not to be a mass murderer today. Have you figured the odds?

This justice of the peace is obviously an anti-gun liberal. This 73yr old retired teacher is going nowhere, and the presumption of innocence is over whelming, not lacking.

The next time you are in Starbucks or Target or WalMart or where ever you see open carry of a firearm, remember, the only thing between you and death is the desire of that gun whack not to be a mass murderer today. Figure the odds...worth it?
