From the Ask Joe file one of our viewers has a question about a recent criminal case in Storey County.
Jana wrote in asking what happened to Bum Hess, the former Storey County Commissioner who was arrested for assault at a high school basketball game ?
Bum Hess went to court on a felony battery charge but the case never made it past a preliminary hearing.
Justice of the Peace Ed Johnston ruled there was not enough evidence to take the case to trial.
However it is not necessarily a closed case yet.
The Nevada Attorney General's office prosecuted the case because Storey County had a conflict since Hess used to be a county commissioner.
Jennifer Lopez, spokeswoman for the Nevada Attorney General's office, says they have not made a decision on whether to appeal the judge's ruling.
Lopez says they have until February to make a decision so until they decide, things are still up in the air when it comes to the Bum Hess case.
