Brooks files writ in Nevada Supreme Court

LAS VEGAS (AP) --Embattled Nevada Assemblyman Steven Brooks has filed a writ with the state Supreme Court seeking a mandate that he be seated in the Legislature.

The legal filing late Thursday claims the Legislature lacks authority to put him on leave and banish him from the legislative building.

Brooks' lawyer Mitchell Posin argues Brooks was elected by voters, has already been seated in the Legislature and "has a right and duty" to serve his North Las Vegas constituents.

The court action came the same day Brooks was charged in Las Vegas with a felony, gross misdemeanor and two misdemeanors stemming from an altercation on Feb. 10.
