Burgarello hearing postponed until late July

SPARKS, Nev. (MyNews4.com & KRNV) -- The man accused of killing a trespasser and injuring another on his vacant property was back in Sparks Justice Court on Tuesday.

Sparks Justice of the Peace Chris Wilson decided to send 73-year-old Wayne Burgarello's case to Washoe District Court Judge Adams for further procedures, postponing a preliminary hearing that was scheduled for Thursday. Judge Adams will determine if Burgerello is competent to stand trial.

The next hearing is scheduled at the Second Judicial District Court at 9 a.m. on July 30.

Sparks Police allege Burgarello shot and killed 34-year-old Cody Devine and wounded Janai Wilson after he found them trespassing on his vacant property. Burgarello says he acted in self-defense.
