CARSON CITY, NV (KRNV & MyNews4.com)-- A select legislative committee voted Tuesday night to recommend the expulsion of embattled assemblyman Steven Brooks.

The vote came after more than three hours of deliberation and ended in a 6-1 vote.

Brooks was not present for the meeting or the vote, but was represented by his attorney Mitchell Posin.

Posin says he has not discussed with Brooks if they will fight the decision.

All but a half an hour of the meeting was held behind closed doors due to privacy concerns in the material and information brought forward in the meeting.

Majority Leader and committee chair William Horne, D-Las Vegas says he no longer believes Brooks is fit to serve, but would not go into detail why. Horne explained his reasoning along with the 900 page report detailing Brooks behavior should remain private.

"As Mr. Brooks friend to be honest with you I am glad that those documents are confidential," Horne says.

Assemblywoman Dina Neal, D-Las Vegas of District 7 was the one person to vote against the expulsion Tuesday night.

"I am not at the level where I can move toward the expulsion I'm open for the suspension and for him to seek help I just couldn't come to that point and I need people to understand that about my decision," Neal says.

The final decision will be up to the full assembly. In order for the expulsion to go through there will need to be a two-thirds majority vote.

It is unclear when exactly the assembly will vote, but could be as soon as Wednesday.

News 4 will bring you that information as soon as it is available.
