Court overturns decision to release convicted murderer

LAS VEGAS, Nev. (KRNV & MyNews4.com) -- Nevada Attorney General Catherine Cortez Masto announced earlier today a unanimous panel of the Ninth Circuit Court of Appeals reversed a federal District Court decision which had set aside Letisha Babb’s murder conviction.

Babb, 34, of Reno, was convicted of murder in connection with the 1997 robbery and death of taxicab driver John Castro. In 2011, a federal District Court ruled that Babb must be retried or released due to the use of erroneous jury instructions at her trial.

Babb remains imprisoned, at the Florence McClure Women's Correctional Center, on a sentence of life without possibility of parole.
