CARSON CITY, Nev. ( & KRNV) -- Lawyers for the man accused of a fatal road rage incident say it's all a misunderstanding.

Leonardo Cardoza's attorneys are saying that Desiree Bragg was killed in a drunken accident putting the car in reverse instead of drive, not a road rage incident. District Attorney Neal Rombardo said Cardoza followed the couple in an apparent case of road rage.

The 27-year-old Cardoza is being tried for an Open Murder charge in her death, and an Attempted Murder charge for allegedly trying to kill Bragg's fiance. Bragg died four days after Cardoza's vehicle pinned her against the wall of her mother's Carson City home.
