ELKO, Nev. (AP) — Former Elko County District Attorney Gary Woodbury has been issued a summons for battery in an alleged confrontation with sheriff's deputies providing security last September at the county fair.
Two reserve deputies said in Elko Justice Court documents the Sept. 1 incident occurred when they were asking people to stop congregating on the grandstand walkway. The reserve officers claim Woodbury refused and subsequently pushed one of them.
The Elko Daily Free Press reports that later, when they asked him to leave the fairgrounds, he allegedly swore at one and challenged them to arrest him.
Undersheriff Clair Morris said he's not sure why it took so long to bring formal charges. A court date has not been set.
Woodbury served as the DA for 16 years before retiring in 2011.
