RENO, Nev. (KRNV & MyNews4.com) -- Two people say the man who carjacked a Nevada Highway Patrol vehicle attempted to carjack them by use of a gun. They are now filing a complaint against NHP Officer Robert Nivarel and NHP for negligence, according to court documents.
The documents say David Nichols and Crystal Nichols were driving on I-80E with their two young children on Jan. 28, when they passed by what appeared to be a routine traffic stop. The documents say as soon as they passed the scene, an NHP vehicle sped by and they pulled over. The NHP vehicle pulled over, and a man who was not in uniform got out of the car and held a shotgun at the David, telling him to get out. David referred to his two young children, and the man with the gun went to the car behind theirs.
David and Crystal Nichols say NHP did not act as they should have, causing emotional distress.
