Humboldt County Sheriff: I will not enforce any new unconstitutional gun laws

WINNEMUCCA, Nev. (KRNV & MyNews4.com) - Humboldt County Nevada Sheriff Ed Kilgore Friday sent a letter to Vice President Biden blasting the possibility of new gun laws following an "emotional tragedy". The letter continues to read, "As such, the Humboldt County Sheriff's Office in Nevada will use my discretion and not enforce any new gun laws that may appear unconstitutional."

Sheriff Kilgore also wrote, “In Humboldt County, Nevada, we enjoy the freedoms that the United States Constitution allows each and every one of us. The fact that this current administration seeks to arbitrarily take away one of the very fundamental freedoms that we all are afforded strikes directly at the core of what we value as Americans.” The Sheriff continued to write, "The fact remains that banning particular firearms and restricting magazine capacities will not stop criminals from using firearms to do harm. The firearm is not the problem. There needs to be a concerted effort towards the mental health topic as it relates to firearms."

The letter ends with the Sheriff saying he believes the gun control issues should be handled at the state level and concludes, "You are on notice that my constituents and I will not assist in this attempt to strip previously given Constitutional rights away."

A news release accompanying the letter reads, “The Sheriff, being aware that only the Federal Courts can declare any particular law unconstitutional, laid out in his letter to Washington that he will exercise his discretion as to not enforcing any firearms laws that appear to infringe on the rights of Americans to keep and bear arms within his county.”

Illegals in Nevada are not allowed to carry guns. Enforce THAT LAW. We keep seeing, hearing, and are victims of illegals with guns stealing our money, killing young men (Reno murders)... DEPORT illegals and any non-citizen carrying a gun.

The second amendment had been affirmed by the supreme court to apply to individuals. If you read the words of those who fought to include it, it was meant as a deterrent to tyrants. It is there to give us the power to take back the country from tyrants if necessary. It was meant to insure that the public was armed and equipped simulaly to the military so they could fight government troops. The term "assault weapon" is not in the text either. Neither is computer, radio and television in the first amendment.

I still support the Sheriff after reading all the nonsense. As US Americans, we need to stand by our law enforcement officers who are not afraid of open-carry, and the rules which allow citizens to protect themselves. Our USA is out of control and out of touch because of unknowns -- I am known. The Sheriff is known. We are practicing safety and protection and following the US Constitution and the Bill of Rights. I re-encourage that we as citizens stand still and remain united. The Humboldt County Sheriff voice and position statement is spot on! Yes, I carry and have bullets and open carry is allowed in my beautiful state.

Sheriff Kilgore is a hypocrite!! I can't tell you how many times cases have been thrown out of court because his deputies have violated their constitutional rights!!! This ploy of his is for political gain only!!

Good..we then will be creating more and reestablishing mental health services and outlets....especially in rural areas where they have closed due to budget slashing...and I assume Sheriff Kilgore will be a leader in the effort.

i belive that sherriff kilgore has every right to choose not ot enforce this law and i stand behind him guns dont kill people people kill people! If the president is goiong to outlaw guns than he had better do something about cars to i am an emt and i treat more people for car related injuries than guns so if guns kill people than cars do to maybe they should look at facts of statistics a little more before doing things like this i am an avid gun owner and all my kids know gun saftey right down to my fives year old they know they are not toys. I also know that if someone came in my front door my kids would not hesitate to use force. So maybe MR. PRESIDENT you should look at outlawing cars also for killing people espically vans and suvs because they can haul more people than a car i think facts should be looked at more than just jumping to conclusions. As for giving up my guns i am reminded of a bumper sticker my dad had on his truck growing up "you can have my gun when you pry my cold dead fingers from aound it"

MY NAME CARRIE I GREW UP IN WINNEMUCCA AND I BELIEVE AND I ALSO STAND WITH KILGORE ON WHAT HE SAID. WE HAVE A RIGHT TO OUR WEAPONS AND USE THEM IN ANY DANGER WE FACE. I WILL DO WHATEVER I HAVE TO DO TO KEEP MY CHILDREN SAFE EVEN IF THAT MEANS SHOOTING SOMEONE. I BELIEVE THE PRESIDENT IS NOT LOOKING AT WHAT THE CITIZENS WANT HE IS THINKING FOR HIMSELF. IF ANY WAR EVER STARTED ON MY TURF I AM DAMN WELL GOING TO PROTECT IT. THE PRESIDENT HAS ARMED MEN AROUND HIM AND HIS FAMILY SO WE SHOULD ALSO HAVE THAT RIGHT. IF HE TAKES FROM US THEN HE SHOULD DISARM HIS OWN MEN AND BE LIKE THE REST OF US. ED I WILL STAND WITH YOU AND I BELIEVE THAT YOUR LETTER IS HONEST AND TO THE POINT WE HAVE A RIGHT AND I WILL ALWAYS PROTECT MY RIGHTS. IF I HAD TO CHOOSE TO BE BACK IN WINNEMUCCA I SURE WOULD GO BACK AT LEAST I KNOW MY SHERIFF WILL STAND UP FOR US. WAY TO GO SHERIFF KILGORE.

I am Bobby Hartley and I stand by Sheriff Kilgores letter. I lived in Winnemucca out in Star City for 17 years. I am a avid gun owner and believe that children should be taught the right and wrong of gun. Guns do not kill people, people kill people. Their mental ability should be taken into view before they are allowed to purchase a weapon. Ed Kilgore, I and my wife will stand by you on your decision any day of the week. My kids and grandkids grew up around guns and know what to and what not to do. We know Ed Kilgore and his brother and family.

@Speed I have read the Constitution and the Bill of Rights and I guarantee you the right to an assault rifle is nowhere to be found. You gun nuts (emphasis on nuts) always gloss over the fact that most of you are NOT in the militia (in the state guard), so the 2nd amendment does not apply to you. You want a gun?... Join the guard.
