Judge Denies Motion To Suppress Evidence In Whittemore Trial

LAS VEGAS, Nev. (KRNV & MyNews4.com) --Judge Larry Hicks has denied a motion to suppress evidence in a trial involving Harvey Whittemore and alleged illegal contributions he made, in a Las Vegas Federal Courtroom on April 3.

Whittemore is the former Nevada lobbyist and businessman accused of making illegal contributions to Senator Harry Reid's campaign in 2007.

Reno-based Judge Hicks flew to Las Vegas this week to hold an evidentiary hearing with all parties present in person. According to our Las Vegas station KSNV, defense attorney's for Harvey Whittemore tried to argue a violation of the Fourth Ammendment and said that an unlawful seizure took place when Whittemore's leftover files were recovered after he parted ways with his company. The files, according to prosecuters, contain documents, bank statements and contribution checks that help prove their case.

With the denied motion, a large amount of evidence will be presented at the trial. The evidence could prove critical to the prosecution as they claim tens of millions of dollars were contributed to Reid's 2007 re-election campaign through Whittemore's family members and employees. Those family members and employees were later allegedly reimbursed by Whittemore and prosecuters say those documents will show that.

Harvey Whittemore left the Federal Courthouse without saying a word and would not answer any questions from KSNV. Whittemore is charged with four counts, including making contributions in the name of another and exceeding federal limits, lying to the F.B.I.  and causing Senator Reid to file a false report.

Whittemore's trial is set to begin on May 14 and if convicted, he could facing five years in prison and fines.
