ARMAGOSA VALLEY, Nev. (KRNV & MyNews4.com) -- A man has been arrested for murder and two counts of assault with a deadly weapon after shooting and killing a man on Feb. 17 in Armargosa Valley.

The incident happened at 1178 N. Tamarack Road. Nye County Sheriff's Office Deputies say they found John Sprague suffering from a gunshot wound to the abdomen. First aid was given initially by NCSO Deputies and then he was transported by Armargosa Ambulance. During the transition from ambulance to helicopter, Sprague died as a result of a gunshot wound.

NCSO says during their investigation, they concluded that on Friday Feb. 15, suspect Avery Church had gone over to the residence of a family member. While there, he got into an argument with four teenage males and an adult family member. During that altercation, it was reported to NCSO that Church pulled a handgun and threatened them with it. He ultimately left without further altercation.

NCSO says on Feb. 17, the same four teenage boys were collecting firewood across the street from 1178 N. Tamarack Road. NCSO Detectives say that Church got into an argument with the boys, and ultimately pulled out a gun and pointed it at them. NCSO says after he then spun around and fired two rounds into a stump nearby. The boys left the area and reported the incident to an adult family member who was with Sprague. NCSO says Sprague then went to Church's home to confront him, where he Sprague was shot and killed.

Church reports that Sprague had punched him two times which he felt put him in danger, and as a result shot him.

Avery Church was arrested and booked into NCSO Detention and is being held without bail.
