Sparks City Council to discuss amending zoning ordinance related to medical marijuana

SPARKS, Nev. ( & KRNV) -- The city of Sparks needs to address and change their zoning ordinances to adjust to state laws regarding medical marijuana. Sparks City Council will meet Monday afternoon to discuss amending Title 20.

"The action that the Sparks City Council will be asked to take on Monday is to consider approving an amendment to the City's zoning ordinances that would allow for medical marijuana facilities for the cultivation, the growing, and the testing," City of Sparks Public Information Officer Adam Mayberry says.

For some background, first voters in Nevada passed Question 9 in 2000, amending the state constitution to sanction medical marijuana and to allow physicians to authorize qualified patients to consume and grow cannabis for personal use.

Then in 2013, SB 374 was signed into law, which directs the Nevada Department of Health and Human Services to develop regulations for, oversee the creation of, licensed establishments to produce, test and dispense marijuana and maijuana-infused products to patients for medical use.

As of April 1st of this year the final regulations became effective and the State began to process to accept applications for medical marijuana establishments.

It will be up to the state approve the medical marijuana establishments to operate in.

Although they must be in compliance with local government ordinances and receive any required approvals from the city the operate in, if those ordinances are not in place, they don't have to seek approval.

Hence, the reason the Sparks City Council wants to address new ordinances and take on amending Title 20.

"That's important because it allows the city to have a standard and maintain control of those operations should they come to Sparks," Mayberry says.
