Conviction upheld in 1998 Reno deliveryman killing

RENO, Nev. (AP) — A man convicted of murder in the 1998 death of a food deliveryman in Reno won't get a new trial after all.

The Nevada Attorney General's Office announced Monday that the conviction against 33-year-old Ryan Oshun Moore will stand.

Authorities say Moore and three other people conspired to rob a man who they thought was delivering drugs. Branson Clark was shot and killed as he left an apartment, but turned out to be dropping off food and not drugs.

A jury convicted Moore in 1999, but Moore challenged the decision in state court and filed a federal petition raising claims of trial errors.

A federal district court ruled that Moore should get a new trial, but the Ninth Circuit Court of Appeals reversed that decision in a ruling dated Friday.
