ELKO, Nev. (AP) — A northeast Nevada man convicted of murdering a baby 17 years ago has been released from jail on bail while he awaits a new trial after the state Supreme Court threw out his conviction.
The Elko Daily Free Press reports that 44-year-old Patrick McCormick of Carlin posted a $100,000 bail bond and was released from the Elko County Jail on Tuesday.
McCormick had been serving a life sentence with the possibility of parole for the murder of 14-month-old Jacob William Jones in June 1995.
Prosecutors say he beat the boy to death. McCormick's lawyers suggested he died from an allergic reaction to penicillin.
The Supreme Court cited ineffective counsel in ordering a new trial in November.
McCormick appeared in district court on Monday. A status hearing is scheduled March 4.
