SANTA ANA, Calif. (AP) — Orange County prosecutors won't file criminal charges against a Santa Ana police officer who shot a man in the back of the head.
The Los Angeles Times (http://lat.ms/1dwh3jp ) says a prosecutor wrote to interim Police Chief Carlos Rojas this week, saying credible evidence supports an account of the confrontation by Officer Frank Gutierrez.
Gutierrez shot and killed 21-year-old Andres Ramirez in 2010. Gutierrez told investigators that he shot Ramirez because the man was holding a knife as he backed toward the officer.
Gutierrez waited 20 months to make a statement to investigators. He only agreed to be interviewed last year after Ramirez's family settled a wrongful-death lawsuit against the city for about $1 million.
