LAS VEGAS (AP) — A lawyer says a Nevada lawmaker accused of threatening a state Democratic Assembly leader plans to be sworn in when the state Legislature convenes on Monday.
Attorney Mitchell Posin said Monday that Steven Brooks traveled to Carson City on Sunday and feels like he's back among friends.
Brooks was released last Thursday following a five-day mental evaluation.
Legislative leaders plan to form a committee to investigate whether the Democrat from North Las Vegas is fit to serve. He was elected in November to a second term representing District 17.
Brooks was arrested Jan. 19 and accused of threatening incoming Democratic Speaker Marilyn Kirkpatrick.
He said Friday he intends to take his seat.
