Fresh & Easy to pay $800,000 for false advertising

SAN DIEGO (AP) — A judge has fined the owners of Fresh & Easy stores for charging more for items than the posted or advertised prices.

San Diego County District Attorney Bonnie Dumanis said Tuesday the judge ordered Fresh & Easy Neighborhood Market Inc. to pay $833,136.

Superior Court Judge Randa Trapp also ordered stores to offer consumers $3 off the lowest advertised price if they are overcharged. If the item is $3 or less, it will be free.

Prosecutors in San Diego and Riverside counties filed a civil complaint alleging the company posted advertised prices in stores and then charged more at the register.

Prosecutors also say meat and seafood were marked higher per pound than the shelf prices indicated.

The company says the mistake was unintentional and it has taken preventative measures.
