UPLAND, Calif. (AP) — A Southern California couple is heading to court to evict their live-in nanny who refuses to work or leave.

Marcella Bracamonte tells The San Bernardino Sun that the nanny she hired off of Craigslist, 64-year-old Diane Stretton, is squatting in her family's home.

Bracamonte says Stretton was hired in March with good references but the nanny made the home a hostile environment.

Bracamonte and her husband fired the nanny after she stopped working, but Stretton asserted her rights as a tenant and hasn't left. She's threatened to sue the couple for elder abuse.

The family says they are filing eviction papers in court.

Stretton's name appears on the state's list of vexatious litigants, a list of those who generally file frivolous court claims.
